CanWest Auctions & Liquidations Inc. Seller Disclosure Policy

At CanWest Auctions & Liquidations Inc., transparency and trust are fundamental to ensuring a fair and reliable auction process. This Seller Disclosure Policy outlines the requirements for vehicle sellers to accurately represent the condition of their vehicles, allowing buyers to make informed decisions, which leads to a strong sale for all. Seller’s Duty to Disclose, Sellers are required to exercise due diligence in identifying any issues with their vehicles. If defects should have been reasonably known through standard ownership or driving, the seller must disclose them. Failure to do so may result in penalties, sale cancellation, or potential legal action for misrepresentation.

Given the varying age, condition, and ownership history of vehicles, CanWest Auctions has established three classification levels to set clear disclosure expectations so buyers can bid with confidence: Vehicle Category Classification Each vehicle will be categorized based on its condition and level of disclosure:

1) (Red Banner) Project Vehicles These vehicles are sold “as is” with no guarantees regarding their condition. Sellers must accurately declare whether the vehicle is running or non-running.

  1. A) Running Vehicles A vehicle is classified as “running” if it meets the following criteria:
  • Starts with or without a boost.
  • The engine does not exhibit knocking, serious cam/lifter noise or has excessive exhaust smoke (burning oil or coolant).
  • The transmission engages and moves the vehicle forward and backward without slipping (including manual transmissions).
  • The brakes can stop the vehicle at a safe distance. · There is no major frame or rust damage that compromises safety.
  1. B) Non-Running Vehicles A vehicle is considered “non-running” if it has one or more of the following issues:
  • Will not start.
  • Exhibits engine knocking or serious cam/lifter noise or excessive exhaust smoke (burning oil or coolant).
  • The transmission does not engage or slips.
  • Brakes are non-functional or unsafe.
  • Major frame or rust damage that renders the vehicle unsafe.

These vehicles are typically suited for mechanics, hobbyists, or buyers comfortable with undertaking repairs.

2) (Yellow Banner) Buyer Protection Vehicles (BPV) These vehicles are expected to be free of major mechanical issues unless explicitly disclosed by the seller. If a vehicle sells for more than $6,000 (excluding GST and fees) and has any of the following undisclosed major issues requiring repairs exceeding $650 (per repair), the buyer will be protected under the Buyer Protection Program: Required Seller Disclosures for BPV Vehicles:

  • Engine, transmission, or drivetrain issues that affect drivability.
  • Structural damage.
  • Previous accidents and insurance claims (Carfax)
  • Rust or corrosion beyond normal wear.
  • Electrical, suspension, or braking system problems affecting drivability.
  • Major body damage and/or visible poor-quality repairs.
  • Non-functional major features (e.g., air conditioning, airbags, infotainment systems, power windows, sunroofs, convertible tops).

Specific Mechanical Issues Covered Under Buyer Protection:

  3. Transmission Issues – Missing gears or slipping in both automatic and manual transmissions.
  4. Drivetrain Issues – Non-functional transfer cases or severe deferential problems affecting drivability.
  5. Major Suspension or Braking System Failures – Issues causing significant drivability problems.

 Important Notes:

 3) (Green Banner) Inspected Vehicles These vehicles have undergone an AMVIC Mechanical Fitness Inspection, a copy of which is attached to the auction listing. They may be eligible for financing and, depending on the year, may qualify for an extended warranty. Bernie and the team at CanWest Auctions were great! They helped me with making the big step of downsizing. Not only did they take care of dealing with over 30 years of stuff that filled my 3000sq foot house, but they also took care of selling my cars. Best of all they helped me donate many items for a tax receipt so very little went to the dump.

I was looking for good dependable and affordable car for my daughter as her first car. After spending weeks trying to buy something good on Market Place and Kijiji. we were about to give up. Then we found the perfect car for her on the CanWest Auction at a great price. It was quick and easy and it has been a great car for us.

When my father passed away, we were so busy with all of the estate stuff we did not want to deal with trying to sell his car. CanWest Auction looked after everything quickly and got us more than we thought possible for the car.

I had a 2013 Nissan Pathfinder that needed some work that I no longer needed. I did not want the hassles of selling it myself on marketplace or Kijiji so Canwest sold if for me fast and easy for a fair price.
