Buyer Policy for Vehicle Auctions

Buyer Policy for CanWest Estate Auction and Liquidation Inc. (Online Only Auction) Effective Date: December 10, 2024 Welcome to CanWest Estate Auction and Liquidation Inc. (“CanWest”). This Buyer Policy governs all transactions and participation in our online-only vehicle auctions. By registering and bidding in our auction, you agree to comply with all terms and conditions outlined below. Please read them carefully.

  1. Auction Participation

1.1 All buyers must register with CanWest before bidding in the online auction. Registration requires providing valid identification, proof of residence, and contact information.

1.2 As part of the registration process, a $500 deposit will be charged to your credit card. This deposit is refundable based on the terms outlined below.

1.3 By registering and bidding in our auction, you confirm that you are legally able to enter into binding contracts in Alberta, Canada, and that you are not prohibited from purchasing vehicles by any governing authorities.

  1. Bidder’s Responsibility

2.1 Bidding on vehicles in CanWest auctions is conducted online, and it is the bidder’s responsibility to ensure they fully understand the vehicle they are bidding on. Buyers must carefully review all available information, images, and descriptions before placing a bid.

 2.2 Once a bid is placed, it is a binding commitment to purchase the vehicle at the winning bid price. If you are the winning bidder, you are legally obligated to complete the transaction.

  1. Vehicle Condition

3.1 All vehicles sold at CanWest auctions are sold “AS IS, WHERE IS,” with no warranties or guarantees of any kind. CanWest makes no representations or warranties regarding the condition of any vehicle, including but not limited to the mechanical, structural, or aesthetic condition.

 3.2 Some vehicles are located at the CanWest facility, and others are located at the seller’s location. Vehicles at the CanWest facility will be available for viewing on set viewing days, which will be listed in the auction details. Vehicles located at the seller’s location are available for viewing by appointment only.

3.3 It is the buyer’s responsibility to arrange for and conduct their own inspection of the vehicle prior to placing a bid. For vehicles located at the seller’s location, the buyer must contact the seller via the messaging system provided by CanWest to schedule a viewing.

 3.4 CanWest strongly encourages buyers to inspect the vehicle in person before bidding. CanWest is not responsible for any claims regarding the condition of the vehicle after the auction closes.

  1. Buyer’s Premium

4.1 A buyer’s premium of 6% of the purchase price to a maximum of $600.00 will be added to the final hammer price of each vehicle. The total price is the purchase price plus the buyer’s premium and taxes.

  1. Payment Terms

5.1 All payments must be made in full within [Insert Number of Days] days following the auction. Accepted payment methods include [list payment methods: bank transfer, certified cheque, credit card, etc.].

5.2 Failure to pay in full within the specified time will result in the forfeiture of the vehicle and the forfeiture of your $500 deposit. CanWest reserves the right to retain the vehicle and resell it without further notice if payment is not received.

 5.3 Buyers are responsible for any applicable taxes, fees, and registration costs associated with the vehicle purchase.

  1. Deposit

6.1 As part of the registration process, a $500 deposit will be charged to your credit card. The deposit will be handled as follows: · If you are not the high bidder on any vehicle at the auction, the $500 deposit will be refunded after the sale, typically within [Insert Number of Days] days. · If you are the high bidder on a vehicle, the $500 deposit will be refunded once the vehicle is paid in full.

6.2 The deposit is non-transferable and is used to ensure your commitment to the auction process. If the buyer fails to complete payment for a vehicle, the deposit will be forfeited.

  1. Liability and Indemnity

7.1 CanWest Estate Auction and Liquidation Inc., its agents, employees, and affiliates shall not be held liable for any loss, damage, injury, or claim arising from the purchase, use, or ownership of any vehicle purchased through the auction.

7.2 Buyers agree to indemnify and hold CanWest harmless from any claims, liabilities, losses, damages, or expenses, including legal fees, arising out of or related to the purchase, possession, or use of any vehicle purchased from the auction.

 7.3 CanWest is not responsible for any errors or omissions in the vehicle listings or auction information. Buyers must rely on their own judgment and due diligence when making bids.

  1. Auction Cancellation or Postponement

8.1 CanWest reserves the right to cancel or postpone any auction at its discretion. In such cases, buyers will be notified promptly. CanWest is not responsible for any costs or damages resulting from an auction cancellation or delay.

  1. Transfer of Ownership

9.1 The ownership of the vehicle will transfer to the buyer upon full payment and completion of all required documentation. Buyers are responsible for registering the vehicle in their name with the Alberta Motor Vehicle Registration office and paying any applicable fees. As well Buyers are responsible for arranging a title if required and all associated cost to do so.

  1. Viewing and Inspection

10.1 Vehicles located at the CanWest facility will be available for viewing on set viewing days, which will be provided in the auction details.

10.2 Vehicles located at the seller’s location are available for viewing by appointment only. Buyers must contact the seller via the CanWest messaging system to arrange an inspection.

 10.3 CanWest makes no guarantees regarding the availability or condition of vehicles located at the seller’s location. Buyers are responsible for making arrangements to view the vehicle before bidding.

  1. Dispute Resolution

11.1 Any disputes arising out of or related to the auction shall be resolved through binding arbitration in the province of Alberta, Canada.

  1. Governing Law 12.1 This Buyer Policy and all transactions conducted through CanWest Estate Auction and Liquidation Inc. shall be governed by the laws of the Province of Alberta and the federal laws of Canada.
  2. Changes to Buyer Policy

13.1 CanWest reserves the right to amend or update this Buyer Policy at any time. All updates will be posted on the CanWest website, and it is the buyer’s responsibility to review the policy before each auction. By participating in our auction, you acknowledge that you have read, understood, and agree to the terms and conditions set forth in this Buyer Policy.
